Pendulum Psychotherapy is the psychotherapy practice of Zuzana Tarcalova.
For the purposes of UK data protection law, Zuzana Tarcalova is the data controller responsible for the personal information described in this notice.
Zuzana Tarcalova pays the data protection fee to the Information Commissioner’s Office (ICO).

About this privacy notice
I take privacy and confidentiality seriously. This notice explains what personal information I may collect, why I use it, how it may be stored or shared, how long it is retained and the rights you have in relation to it. Because psychotherapy enquiries can include information about physical or mental health, relationships, sexuality, identity or other sensitive aspects of a person’s life, some information may fall within the special categories of personal data protected by UK data protection law. I aim to collect only the information that is reasonably necessary for the purpose for which it is provided.
Information I may collect
When you contact Pendulum Psychotherapy, I may receive information such as your name, email address, telephone number, preferred method of contact and anything you choose to include in your enquiry.
If we work together, I may also process information that is necessary for arranging and providing psychotherapy, communicating with you and administering sessions and payments.
I do not keep separate clinical case notes of psychotherapy sessions.
Information may nevertheless exist within ordinary communications, appointment arrangements, payment records or other administrative systems for as long as it is required for the purposes explained in this notice.
The website may process limited technical information that is necessary for its secure operation and delivery through Wix. Pendulum Psychotherapy does not use Google Analytics, advertising pixels or behavioural tracking technologies to monitor visitors’ use of the website.
How I collect information
Personal information may be received directly from you through the website enquiry form, email, telephone, WhatsApp Business, communication connected with arranging sessions, and bank-transfer payment information.
Website and analytics providers may also collect limited technical information automatically when you use the website.
Why I use your information
I may use personal information to respond to an enquiry, consider whether I may be able to work with you, arrange and provide psychotherapy, communicate about appointments, administer the therapeutic relationship, receive and identify payments, meet legal or regulatory obligations, and maintain the security and operation of the website.
Lawful basis
The lawful basis I rely on depends on the purpose for which the information is being used.
Where you contact me about psychotherapy, or where we work together, I may process ordinary personal data because it is necessary to take steps at your request before entering into an agreement or to perform that agreement.
I may also process personal data where this is necessary to comply with a legal obligation, or where I have a legitimate interest in operating and administering the practice responsibly and securely, provided that your rights and interests do not override that interest.
Information you provide may include health information or other special-category personal data. Such information is processed only where a condition permitted by Article 9 of the UK GDPR and the Data Protection Act 2018 applies. The appropriate condition depends on the purpose and circumstances of the processing, including the provision of psychotherapy under professional duties of confidentiality.
Confidentiality and supervision
Psychotherapy is confidential within the limits of applicable law and professional obligations.
As part of responsible professional practice, themes from clinical work may be discussed in professional supervision. Material discussed in supervision is anonymised so that the client is not identified.
I do not routinely disclose client information to other people or organisations.
Personal information may be disclosed where I am legally required to do so.
Services used to process information
I use a small number of third-party services in operating the practice.
The website and enquiry form are provided through Wix.
Email communication is provided through Gmail / Google.
Online communication and online psychotherapy sessions may take place using WhatsApp Business / Meta.
Payments are normally made by bank transfer, and payment information is consequently processed by the relevant banking institutions.
Pendulum Psychotherapy does not use Google Analytics, advertising pixels or other third-party behavioural analytics on this website. Wix may process limited technical data required to host, secure and operate the website.
These providers operate their own technical infrastructure and may process information in locations outside the United Kingdom. Where international processing occurs, I rely on the safeguards and transfer mechanisms used by the relevant provider in accordance with applicable data protection law.
Website technology and cookies
This website uses technology that is necessary for its secure operation and delivery through Wix.
Pendulum Psychotherapy does not use Google Analytics, advertising pixels or behavioural tracking technologies to follow visitors around the website or build profiles of their activity.
Where Wix uses storage technologies that are strictly necessary for providing the website, these cannot be disabled without affecting the operation of the service.
How long information is kept
If you make an enquiry but do not subsequently become a client, information relating to that enquiry is retained for up to 12 months and is then deleted unless there is a specific reason or legal obligation requiring it to be retained for longer.
I do not retain separate clinical case notes of psychotherapy sessions.
Routine client communications and administrative information are retained only for as long as reasonably necessary for providing and administering the service and are deleted when they are no longer required, subject to any legal, regulatory or legitimate reason for retaining particular information.
Financial information required for tax, accounting or legal purposes may be retained for the period required by applicable law.
Security
I take reasonable steps to protect personal information and to limit access to it. However, no electronic communication or internet-based storage system can be guaranteed to be completely secure. You should therefore avoid including more sensitive detail in an initial online enquiry than is necessary.
Your rights
Under UK data protection law, depending on the circumstances and the lawful basis being used, you may have rights to request access to your personal information, ask for inaccurate information to be corrected, request deletion of information, request restriction of processing, object to particular processing, receive certain information in a portable format, and withdraw consent where processing is based on consent.

Complaints
If you have concerns about how your personal information has been handled, please contact me first so that I can try to resolve the matter.

Automated decision-making and marketing
I do not use personal information to make solely automated decisions about whether I will work with you.
I do not use information supplied in psychotherapy enquiries for unsolicited marketing.
Changes to this notice
This privacy notice may be updated from time to time to reflect changes in the practice, technology used or legal requirements. The current version will be published on this website.
